Data Protection Guide for Owners’ Management Companies

The Data Protection Commissioner recently published a guide “Considerations Relating to Multi-Unit Developments and Owners’ Management Companies.”

This guidance sets out general advice on common data protection issues that may arise in the course of interaction between:-

  • Owners’ Management Companies (“OMCs”) and their members
  • OMCs, OMC members, and a property management agent
  • OMCs and third parties

The guidance includes information on:-

  • Register of Members
  • Meeting Minutes
  • Use of the Register by Members
  • OMCs & Financial Management

Company Constitutions

Many OMC’s constitution does not fully provide for the activities of a Multi-Unit Development and have conflicts with the MUD Act particularly in relation to voting rights of the Unit Owners.

If you require assistance in drafting an appropriate constitution for an OMC or have any queries, please feel free to contact us at cosec@clscs.ie or 059-9186776
